Version 1.0 · applies to every Berry FX plugin
What you get
A permanent, non-exclusive license to install and use the software on two computers you control, for anything you like, including commercial work. No royalties, no registration, no restrictions on what you make with it. Music you produce with it is entirely yours and always was.
“Permanent” means permanent. It does not expire, it does not need renewing, and it does not stop working if this company does.
What you may do
- Use it on two machines at once, and move those two whenever you like.
- Install it on as many machines as you own, activating any two at a time.
- Use it commercially, in a studio, for clients, on releases.
- Keep a backup of the installer.
What you may not do
- Share your license key or a license string with anyone else.
- Circumvent the licensing, or distribute anything that does.
- Redistribute, resell or bundle the plugin itself.
- Reverse-engineer it, except where your local law says you may regardless of this agreement, in which case that law applies and this line does not.
A teaching lab, a studio with more than two rooms, or any case where two seats genuinely does not fit: write to us. That is a conversation about a site license, not a violation.
License verification
The software verifies its license on your machine, and checks in with us periodically to confirm that it is authorized for licensed use. What that transmits, and how long it is kept, is set out in the privacy policy.
Updates
Updates within a major version are free, for as long as we make them. If there is ever a paid version 2, you are not obliged to take it, and your version 1 keeps working exactly as it does today.
Warranty, and the honest version of it
The software is provided as-is, without warranty of any kind. That sentence is in every EULA ever written, so here is what it means in practice: we test each release against an automated suite and against pluginval at maximum strictness before it ships, and if it breaks something we want to know and we will fix it. What we cannot do is promise it is flawless, or accept liability for a session lost to a bug.
Our total liability is limited to what you paid. Some jurisdictions do not allow that limitation, and where yours does not, it does not apply to you.
Ending it
This license ends if you breach it. Realistically, if you distribute a crack. Nothing else here is grounds to take away something you bought.
Ownership and trademarks
You bought a license to use the software, not the software itself. The source code, interface designs, artwork, logotypes, factory presets, documentation and audio content distributed under the Berry FX name remain the copyrighted property of Elefant Music LLC, and may not be reproduced, distributed or used to create derivative works without written permission.
Berry FX™, Berry Effects™, the Berry FX logo, Sweet-R™, Candi-D™, Juic-C™, Compote™ and Ripeness™ are trademarks of Elefant Music LLC, as are the berryeffects.com name and domain.
None of that restricts the records you make. Audio you produce using these plugins is yours, with no claim, credit or royalty owed, as “what you may do” above says.
Third-party notices
The plugins are built on JUCE and include the Steinberg VST3 SDK under its MIT terms. VST3 is a trademark of Steinberg Media Technologies GmbH. The typeface is Gelasio, under the SIL Open Font License 1.1; the license text ships inside the plugin and is readable from its settings panel. Signature verification uses Monocypher, taken under CC-0.
Berry FX designs its own circuits and models, and is independent: it is not affiliated with, endorsed by, sponsored by, or connected to any hardware manufacturer whose sound a plugin may evoke. The names and model numbers of classic units, such as the 1176 and the LA-2A, and companies such as Universal Audio, Teletronix, Fairchild, dbx, Neve and Solid State Logic, are the trademarks of their respective owners. Where such a name appears, it is used only to describe a sonic character, never to suggest that unit or its maker had a hand in this software.
Apple, macOS, Audio Units and Logic Pro are trademarks of Apple Inc.; Windows is a trademark of Microsoft Corporation; and other host and platform names, such as Ableton Live and REAPER, belong to their respective owners. Naming a host so you know the plugin runs in it is a statement of compatibility, not a claim of endorsement by its maker. All other product and company names mentioned are the trademarks of their respective owners.
