Who you are buying from

Berry FX is a trading name of Elefant Music LLC, a limited liability company formed in the State of Delaware, United States. Elefant Music LLC is the seller of record for every purchase made on this site.

What is being sold

A license to use software, delivered electronically. Not a physical product, and not a subscription. What the license permits is in the license agreement.

Prices and tax

Prices are in US dollars and are shown excluding tax. Where VAT, GST or a sales tax applies to you, it is calculated from your billing address and added at checkout, before you pay, so you always see the final figure first.

Businesses in the EU can enter a valid VAT number at checkout; where the reverse charge applies, no VAT is added.

Payment

Card payments are handled by Stripe. Card details are entered on Stripe’s pages and never reach this site.

Delivery

Immediately. Your license key appears on your account page as soon as payment clears, and a copy is emailed. If the email does not arrive, the key is still on your account page. That is the real delivery, and the email is a convenience.

By buying, you ask for immediate delivery and acknowledge that this waives the statutory withdrawal right for digital content. We give a 14-day refund window regardless. See refunds.

If something goes wrong with the purchase

If you are charged and no license appears, email us with the order number. It will be issued by hand within a day, or refunded, whichever you prefer. This is the failure we most want to hear about and the one we are quickest to fix.

Availability

Plugins listed as in development are not for sale and have no date. No pre-orders are taken and no deposits are held.

Governing law

These terms, and any dispute arising from them, are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules.

That clause does not take anything away from you. Consumer protection law in the country you live in generally applies whatever a governing-law clause says, and where the two differ, your local rights win. If you are buying from the EU or the UK, your statutory rights — including the fourteen-day withdrawal period described in the refund policy — apply regardless of this section.

Changes

These terms may change. The version that applies to a purchase is the one published when it was made, and changes are never applied retroactively.
